2. SeaMiles service

SeaMiles is a digital service for recording and organising sailing voyages, nautical miles, crew participation, positions, notes, certificates and related sailing information. Features may differ by plan.

3. Account and acceptance

By creating a SeaMiles account and actively accepting these Terms during registration, you enter into an agreement with Plan B SeaSide Assets d.o.o. You must provide accurate account information, keep your credentials confidential and use SeaMiles lawfully. SeaMiles may record the applicable Terms version and the time of acceptance for evidence and contract administration.

4. Viewer and Creator plans

The Viewer plan is free of charge. New Creator subscriptions include a voluntary 14-day free trial. No Creator subscription fee is charged during the trial. Unless cancelled before the trial ends, the Creator subscription automatically becomes a paid subscription at €4.99 per month and renews monthly until cancelled. Stripe processes subscription payments. Taxes and other legally required payment information displayed during checkout form part of the purchase information.

The free trial is a voluntary SeaMiles benefit and is offered independently of any mandatory statutory withdrawal or consumer rights.

5. Cancellation, free trial and continuation as Viewer

A Creator subscription may be cancelled at any time through the SeaMiles account area. If you cancel during the 14-day free trial, no Creator subscription fee is charged. Creator access remains available until the end of the trial and the account then automatically continues as Viewer.

After the free trial has ended, cancellation takes effect at the end of the current paid billing period unless mandatory law requires otherwise. Creator features remain available until that date, after which the account automatically continues as Viewer.

Existing sailing history is not deleted merely because a Creator subscription or trial ends. No refund is due for an already started billing period unless required by applicable law. If SeaMiles offers a “Keep Creator subscription” option, a scheduled cancellation can be withdrawn before the applicable trial or billing period ends.

6. Statutory withdrawal rights

Mandatory consumer withdrawal rights remain unaffected. Where a statutory withdrawal right applies, you may exercise it within the applicable period by a clear statement to support@seamiles.one or through any withdrawal functionality provided by SeaMiles. Any legally required refund, compensation for services already supplied or other consequence is governed by mandatory law.

7. Intellectual property

SeaMiles, its software, source code, design, branding, logos, interfaces, databases, documentation and other service components are owned by Plan B SeaSide Assets d.o.o. or its licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, you receive a limited, non-exclusive, non-transferable and revocable right to use SeaMiles for the intended purpose of the service for the duration of your account or subscription. No ownership in the SeaMiles software or brand is transferred to you.

8. User content and crew data

You retain ownership of content you submit to SeaMiles. You grant SeaMiles the limited rights necessary to host, store, process, reproduce, transmit and display that content solely to operate, secure, maintain and improve the service and to provide the functions you request.

You are responsible for having an appropriate legal basis for personal information you enter about crew members and for keeping records reasonably accurate.

9. No navigation or safety reliance

Position, course, speed, weather, logbook and other sailing information may be inaccurate, incomplete, delayed or unavailable. SeaMiles must not be relied upon for navigation, collision avoidance, voyage planning, emergency response or any other safety-critical decision.

SeaMiles is not a substitute for legally required ship logs, official certificates, navigation equipment, safety procedures or professional seamanship. The skipper remains responsible for the safe conduct of the vessel and compliance with applicable law.

10. Availability and changes

SeaMiles aims to provide a reliable service but does not guarantee uninterrupted or error-free operation. Maintenance, technical failures, third-party services and internet connectivity may affect availability. Features may be changed, improved or discontinued where reasonably necessary, without limiting mandatory consumer rights.

11. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.

Free Viewer service. Liability is excluded to the fullest extent permitted by applicable law. Where such exclusion is not legally permissible but liability may lawfully be limited, the aggregate liability arising out of or in connection with the free service shall not exceed EUR 50.

Paid Creator subscription. For claims for which liability may lawfully be limited, the aggregate liability of SeaMiles and Plan B SeaSide Assets d.o.o. arising out of or in connection with the service shall not exceed the fees actually paid by the user for the Creator subscription during the twelve months preceding the event giving rise to the claim.

To the fullest extent permitted by law, SeaMiles is not liable for indirect, incidental or consequential losses, loss of profits, or loss arising from reliance on SeaMiles for navigation or safety-critical decisions.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability for intent, gross negligence, death or personal injury, fraud, or mandatory consumer rights.

12. Account suspension and termination

SeaMiles may restrict or suspend an account where reasonably necessary to protect the service, other users, security or legal compliance, or in the event of a material breach of these Terms. Mandatory notice and consumer rights remain unaffected.

13. Governing law

These Terms are governed by Croatian law, without depriving consumers of mandatory protections granted by the law of their habitual residence where such protections apply.

14. International users

SeaMiles is operated from Croatia and may be used by customers in other countries. Users outside the European Union may have additional mandatory rights under the laws applicable in their country of residence. Nothing in these Terms is intended to exclude or restrict consumer rights that cannot legally be excluded. The 14-day free Creator trial is a voluntary SeaMiles benefit and does not replace any mandatory local cooling-off, withdrawal, refund or consumer rights.
